Lord Brougham gave judgment today in the Judicial Committee of
the Privy Council in the case of Escort versus Mastin, on an appeal from the Ecclesiastical Court. A suit had been brought in that court against the Reverend Thomas Sweet Escott, the Vicar of Gedney, for refusing, on the 16th and 17th of December 1839, to read the burial- service over the body of a child, the daughter of Thomas and Sarah Cliff, on the ground that she was not baptized ; the ceremony of bap- tism having been performed by a Wesleyan minister ; and Sir John Nichol sentenced the Vicar to be suspended from the functions of his clerical office for three months. The Judicial Committee affirmed that sentence, with costs.
